Court Rulings— Week of May 22

Jaime Jorge Kerr was convicted on one count of official misconduct in the first degree on Thursday, May 9. The charge stems from an incident that occurred on or about Jan. 2, 2011. Kerr was placed on bench probation for one year.  Fifteen counts of official misconduct in the first degree were dismissed.

Johnny B. Martinez was convicted of one count of failure to appear in the first degree based on a guilty plea entered on Thursday, May 9.  The charge stems from an incident that occurred on or about May 7.   Martinez was sentenced to 18 months of supervised probation.  Martinez was additionally convicted on one count of burglary in the second degree, also based on a guilty plea entered on May 9.  The charge stemmed from an incident that occurred on or about Feb. 22, 2007.  For this charge, Martinez was sentenced to 60 days in jail and 24 months of supervised probation.  One count of theft in the second degree was dismissed.

Jerod A. Miller was convicted on one count of possession of methamphetamine based on a guilty plea entered on Friday, May 3.  The charge stems from an incident that occurred on or about March 13. Miller was sentenced to 18 months of supervised probation.

Brandon Douglas Adams was convicted on one count of burglary in the second degree based on a plea of no contest entered on Monday, May 6.  The charge stems from an incident that occurred on or about Dec. 8, 2012.  Adams was sentenced to 20 days in jail and 18 months of supervised probation.

Philip Dustin Kerfoot was convicted on one count of unlawful use of a weapon based on a plea of no contest entered on Monday, May 6.  The charge stems from an incident that occurred on or about Feb. 5, 2012. Kerfoot was sentenced to 20 days in jail and 36 months of supervised probation.  Five counts were dismissed: attempt to commit a class A felony – assault 1, unlawful use of a weapon, unlawful possession of methamphetamine, attempt to commit a class C or an unclassified felony and menacing. Kerfoot was additionally convicted on one count of failure to appear in the first degree based on a guilty  entered on Monday, May 6. The charge stems from an incident that occurred on or about April 1. Kerfoot was sentenced to 24 months of supervised probation. One count of failure to appear in the first degree was dismissed.

Wendy Sue Thomas was convicted on one count of theft in the first degree based on a plea of guilty on Monday, April 29.  The charge stemmed from an incident that occurred on or about Dec. 15, 2012. Thomas was sentenced to 36 months of supervised probation.

Darwin Frederick Smith, III, was convicted on one count of assault in the fourth degree-constituting domestic violence, based on a plea of no contest on Tuesday, April 23.  The charge stems from an incident that occurred on or about July 28, 2011. Smith was sentenced to five days in jail. Two counts were dismissed: one count of strangulation and one count of harassment, both constituting domestic violence.

Michael David Maggio was convicted on one count of unlawful delivery of marijuana for consideration based on a guilty plea entered on Monday, April 15.  The charge stems from an incident that occurred on or about March 7.  Maggio was sentenced to 9 days in jail, optional probation with state corrections for 36 months and 36 months of supervised probation. One count of unlawful possession of marijuana was dismissed.
